Bigroad Terms & Condition

   TERMS AND CONDITIONS OF BIGROAD CAR RENTAL AND TRAVEL SERVICES

This Agreement is made between Bigroad Sdn. Bhd. Company No. 202501045599 (1647007-M) with
its registered business address at 26-02, Zeus Business Park, Jalan Tun Abdul Razak, Susur 4, 

80200 Johor Bahru (hereinafter referred to as “Bigroad”) and the individual or entity making the booking

(hereinafter referred to as “the User”).

1. INTRODUCTION
1.1
Bigroad is a Malaysian-registered company that provides car rental, limousine, hotel, and travel
services to both domestic and international travelers. The Company operates as an integrated travel
and transportation solutions provider, offering car leasing, chauffeur-driven services, and curated
travel packages across Malaysia.

1.2 By proceeding with any booking, the User agrees to enter into this Agreement with Bigroad,
wherein the terms, conditions, and obligations stated herein shall govern all vehicle leases, hotel
bookings, and travel package arrangements made via Bigroad’s official platform at www.bigroad.my
(“the Website”).

1.3 Bigroad reserves the right to amend, revise, or modify any clause within this Agreement at its
sole discretion. Any updated version shall take effect immediately upon publication on the Website.
Continued use of Bigroad’s services constitutes the User’s acceptance of such amendments.

2. ELIGIBILITY AND DRIVING REQUIREMENTS

2.1 Bigroad and the User mutually agree that the leased vehicle shall only be driven by the User
and/or any additional person(s) duly registered during booking and approved by Bigroad (collectively
referred to as “Drivers”).

2.2 Drivers must meet the following age requirements:

  • For standard vehicles, between twenty-three (23) and sixty-five (65) years of age.
  • For luxury vehicles, between twenty-five (25) and sixty-five (65) years of age, with at least two
    (2) years of driving experience.

2.3 All Malaysian drivers must hold a valid Competent Driving License (CDL). Holders of a
Probationary Driving License (P License) are not permitted to rent or drive Bigroad vehicles.

2.4 In accordance with Section 28 of the Road Transport Act 1987, ASEAN-issued driving licenses
are valid in Malaysia provided that they remain valid in their country of origin.

2.5 If the ASEAN license is not in English or Malay, it must be accompanied by a certified translation
issued by either the embassy of the issuing country in Malaysia or the relevant licensing authority.

2.6 ASEAN licenses are valid for use in Malaysia for a maximum of ninety (90) days for visitors on
tourist visas.

2.7 Non-ASEAN nationals must possess a valid International Driving Permit (IDP) issued by their home
country prior to driving in Malaysia.

2.8 Drivers must be medically fit, free from impairments that may affect driving, and maintain a clean
driving record without major traffic offenses for at least five (5) years prior to the rental date.

3. LEASE PERIOD

3.1 The duration of the lease (“Lease Term”) shall be as stated in the booking confirmation
generated via Bigroad’s official website, www.bigroad.my, or any other authorized platform of
Bigroad. The Lease Term begins when the User collects the vehicle and ends upon its return to the
designated location as agreed.

3.2 The User shall return the leased vehicle to Bigroad or its authorized representative at the
mutually agreed location, date, and time. Failure to return the vehicle punctually will result in
additional charges imposed by Bigroad as detailed below:

2.7 Non-ASEAN nationals must possess a valid International Driving Permit (IDP) issued by their home
country prior to driving in Malaysia.

2.8 Drivers must be medically fit, free from impairments that may affect driving, and maintain a clean
driving record without major traffic offenses for at least five (5) years prior to the rental date.

Note:
All late return charges are calculated according to vehicle segment and actual delay duration. If the
delay exceeds five (5) hours, it shall automatically be deemed as an additional one (1) full rental day.

Cleaning fees will vary from RM100 to RM300 depending on the level of dirtiness, odor, or interior
condition upon return.

3.3 The minimum rental period for any vehicle is twenty-four (24) hours. During festive or peak
seasons (including Hari Raya, Chinese New Year, Deepavali, and public holidays), Bigroad may
impose a minimum booking duration of three (3) days.

4. INTERSTATE USAGE AND BOUNDARY POLICY

4.1 Bigroad vehicles are permitted to be driven within Peninsular Malaysia only, unless otherwise
approved in writing by Bigroad management.

4.2 The User must inform Bigroad in advance if the intended journey includes interstate travel such
as Johor–Melaka, Johor–Kuala Lumpur, or other destinations within Peninsular Malaysia. This ensures
proper vehicle scheduling, maintenance, and insurance coverage.

4.3 The User shall not drive or transport the leased vehicle outside of Malaysia — including
Singapore, Thailand, Brunei, or Indonesia — without prior written authorization from Bigroad. Any
violation will result in immediate termination of the rental agreement and forfeiture of the security
deposit.

4.4 Bigroad provides pickup and return services for customers who require delivery or collection
outside Johor Bahru. All interstate service charges listed below are inclusive of Touch ’n Go toll
fees, fuel costs, and driver allowance, with no hidden charges.

3.4 Any request to extend the Lease Term must be submitted before the expiry of the current rental
period. Approval for an extension is strictly subject to vehicle availability and full payment of
additional charges. If the requested vehicle is unavailable, Bigroad reserves the right to decline the
extension or offer an alternative vehicle subject to rate adjustment. Unauthorized extensions will
automatically be charged as late returns under Clause 3.2.

3.5 Early return of the leased vehicle before the expiry of the Lease Term does not entitle the User
to any refund or credit unless expressly approved in writing by Bigroad.

3.6 In the event that the User fails to return the leased vehicle within twenty-four (24) hours after the
agreed return time without notice or authorization, Bigroad reserves the right to recover the vehicle
and report the case to the authorities as vehicle misappropriation or theft.

3.7 Bigroad shall not be held responsible for any delays in collection or return caused by unforeseen
events such as traffic congestion, mechanical issues, or natural disasters beyond its control.

3.8 During the Lease Term, the User is fully responsible for the care, custody, and control of the
leased vehicle until it is officially inspected and accepted by Bigroad’s authorized personnel.

4.5 All charges are one-way only. Round trips will be charged at double the listed rate.

4.6 Customers may request interstate pickup or return directly when making a booking through
Bigroad’s official website or WhatsApp form by specifying their outstation location in the booking
details. Bigroad’s operations team will confirm availability and total charges before proceeding.

4.7 Interstate pickup or return requests must be made at least 24 hours in advance. Approval is
subject to vehicle availability and operational feasibility.

4.8 In the event of a breakdown or accident outside Johor, the User must cooperate with Bigroad’s
recovery process. Towing and repair services beyond Johor Bahru may involve additional costs
based on distance and service provider.

4.9 The User must ensure the vehicle is safely returned to the agreed drop-off point. Late returns or
abandonment outside the designated area will result in towing, recovery, or penalty charges in
accordance with Bigroad’s return policy.

5. DEPOSIT AND CHARGES

5.1 All payments shall be made in Ringgit Malaysia (RM) to Bigroad’s designated bank account as
stated below:

5.2 A refundable security deposit is required for every booking made under Bigroad. The amount
varies depending on the vehicle category and rental duration. The deposit serves as security for any
outstanding fines, damages, cleaning, refueling, or breach of this Agreement.

Bigroad reserves the right to revise these charges at any time.

5.3 The security deposit shall be refunded to the User within seven (7) working days after the vehicle
is returned, provided that:

  1. (a) there are no outstanding traffic fines, summonses, or damages;
  2. (b) the vehicle is returned in the same condition as received; and
  3. (c) all rental charges and fees are fully settled.

5.4 If any deductions are required for damages, fines, refueling, cleaning, or any other breach of this
Agreement, Bigroad reserves the right to deduct the relevant amount from the security deposit. The
balance (if any) will be refunded to the User’s designated bank account after verification.

5.5 Bigroad provides unlimited mileage usage within Peninsular Malaysia unless otherwise stated.
For interstate or cross-district travel, additional operational charges may apply as per Clause 12
(Pick-up, Return, and Interstate Policy).

5.6 Bigroad’s operating hours are from 7:00 AM to 11:00 PM daily, including weekends and public
holidays. Vehicle collection or return outside these hours may incur an additional after-hour service
fee depending on location and time.

5.7 All payments for rental fees and deposits must be cleared before vehicle handover. Bigroad
reserves the right to withhold vehicle release if payment proof is not verified or the amount is
incomplete.

5.8 In the event of cancellation after the payment has been made, any refund or credit issuance will
be processed in accordance with Clause 6 (Cancellation and Refund Policy).

5.9 The User acknowledges that any breach of this Agreement authorizes Bigroad to utilize the
deposit for recovery of losses, penalties, or administrative costs without further notice.

5.10 All payments and refunds are processed via electronic banking (EFT) only. Bigroad shall not be
held responsible for delays arising from banking processing times or inaccurate account details
provided by the User.

6. TERM OF PAYMENT

6.1 To secure the booking, the User is required to make full payment for the rental fee and deposit
before the commencement of the Lease Term. Vehicle handover will only take place once Bigroad
has verified that full payment has been received and cleared in its account.

6.2 All payments must be made in Ringgit Malaysia (RM) or Singapore Dollar (SGD) (for PayNow
users). Bigroad currently accepts the following payment methods:

6.3 Credit and debit card payments are not yet available. Customers are encouraged to use the
alternative payment methods listed above until the card system is fully activated.

6.4 Bigroad reserves the right to cancel or withhold any booking if payment is incomplete, unverified,
or made through unauthorized channels.

6.5 All payments are subject to verification by Bigroad’s finance department. A booking will only be
considered confirmed once official acknowledgment is issued via WhatsApp, email, or Bigroad’s
booking system.

6.6 Refunds or credits arising from cancellations, overpayment, or booking amendments will be
processed in accordance with Clause 6 (Cancellation and Refund Policy).

6.7 Customers are required to keep all payment receipts as proof of transaction for any future
verification or refund request.

6.8 Bigroad reserves the right to update its accepted payment methods, service charges, or
transaction terms without prior notice to ensure smooth and secure payment processing.

7. CANCELLATION AND REFUND POLICY

7.1 In the event that the User cancels a confirmed booking, any refund entitlement shall be subject to
the conditions stated in this section. All cancellation requests must be communicated directly to
Bigroad via WhatsApp, email, or the official booking platform.

7.2 Refund eligibility is determined based on the time of cancellation as outlined below:

7.3 All refunds (where applicable) will be made via online bank transfer (EFT) to the User’s
designated bank account. Bigroad shall not be held responsible for delays arising from banking
processes or incorrect bank details provided by the User.

7.4 Bigroad reserves the right to withhold part or full refund in the event of:

  1. (a) non-compliance with the terms of this Agreement;
  2. (b) falsified or inaccurate booking information;
  3. (c) violation of traffic or legal regulations during the rental period; or
  4. (d) administrative or operational costs incurred by the User.

7.5 Refund requests must include valid proof of payment and booking reference. All eligible refunds
will be processed within seven (7) working days after verification by Bigroad’s finance department.

7.6 Bigroad reserves the right to amend or update this policy without prior notice, in accordance with
company policy, operational requirements, or relevant industry standards. Any revised policy will
take immediate effect upon publication on Bigroad’s official platform.

8. VEHICLE USE AND RESPONSIBILITY

Driving under the influence
Operating the vehicle while under the influence of
alcohol, drugs, or any substance that impairs driving ability.

8.1 The User agrees to use the leased vehicle responsibly and in full compliance with Malaysian
traffic laws and regulations throughout the Lease Term.

8.2 The User shall be fully responsible for the safety, condition, and lawful use of the leased vehicle
during the entire rental period.

8.3 The leased vehicle shall not be used for any of the following purposes or activities as outlined
below:

  • Illegal or criminal activities
    Using the vehicle for illegal purposes such as
    smuggling, transporting prohibited goods, or any unlawful conduct.
  • Commercial subletting
    Leasing, renting, or lending the vehicle to any third party
    or using it for ride-hailing services such as Grab, inDrive, Maxim, etc.
  • Racing or dangerous driving
    Participating in any race, speed test, rally, or reckless
    driving that may cause damage or endanger others.
  • Overloading
    Carrying passengers or luggage beyond the approved seating or loading capacity.
  • Transporting prohibited or hazardous items
    Transporting items that emit strong odors or may
    damage the interior, such as durians, salted fish, fuel, chemicals, or explosives.
  • Smoking or vaping in the vehicle
    Smoking, vaping, or leaving any strong odor inside the
    vehicle is strictly prohibited.
  • Carrying pets
    Bringing animals or pets into the vehicle without prior written approval from Bigroad.
  • Unauthorized cross-border travel
    Driving the vehicle outside of Malaysia (e.g. Singapore,
    Thailand, Brunei, Indonesia) without written authorization from Bigroad.

8.4 The User shall ensure that the vehicle is kept clean and maintained in good condition during the
Lease Term. Any signs of negligence, misuse, or interior damage will result in cleaning, repair, or
replacement charges.

8.5 The User shall be responsible for all parking fees, tolls, traffic fines, summonses, and penalties
incurred during the Lease Term. These must be settled immediately to avoid additional administrative
charges by Bigroad.

8.6 The User must refuel the vehicle to the same fuel level provided upon collection (“full tank to full
tank” policy). Failure to do so will result in a refueling charge based on current petrol prices and
consumption estimation.

8.7 The User shall not modify, tamper with, or replace any part of the leased vehicle, including its
registration plates, accessories, GPS trackers, or internal devices.

8.8 In the event of an accident, breakdown, theft, or loss involving the leased vehicle, the User must
immediately:

  1. (a) contact Bigroad’s customer service or emergency line; and
  2. (b) lodge a police report within twenty-four (24) hours of the incident.

8.9 Bigroad shall not be held liable for any loss of personal belongings, valuables, or items left in the
vehicle during or after the Lease Term.

8.10 Any violation of this section grants Bigroad the right to terminate the Lease Agreement
immediately, repossess the vehicle without notice, and claim any losses or damages from the User’s
deposit or additional charges if necessary.

9. LIABILITY REDUCTION OPTION (LRO)

9.1 The Liability Reduction Option (LRO), also known as the Collision Damage Waiver (CDW), is an
optional protection plan offered by Bigroad that allows the User to reduce financial liability in the
event of accidental damage or theft involving the leased vehicle, subject to the terms outlined
herein.

9.2 LRO coverage takes effect only if the User has subscribed to it before the commencement of the
Lease Term and has made full payment for the LRO fee.

9.3 In the event of an accident or theft, the LRO shall apply only if the User lodges a police report
within twenty-four (24) hours of the incident and submits a copy to Bigroad for verification.

9.5 Once LRO is subscribed, the User’s liability will be limited to the corresponding Excess Fee,
provided that all terms and reporting requirements have been fulfilled.

9.6 LRO does not cover damages or losses caused by negligence or misuse, including but not
limited to:

  1. (a) Driving under the influence of alcohol or drugs;
  2. (b) Driving by an unauthorized person not listed in the rental agreement;
  3. (c) Off-road driving or reckless use;
  4. (d) Damage to tires, rims, windows, side mirrors, undercarriage, or interior components;
  5. (e) Loss or damage to vehicle accessories or equipment (e.g., keys, GPS units, smart tags);
  6. (f) Damage caused by refueling with the wrong fuel type;
  7. (g) Electrical failure due to negligence (e.g., leaving lights or devices on);
  8. (h) Acts of vandalism, civil unrest, or natural disasters;
  9. (i) Theft or loss due to the User’s failure to secure the vehicle properly.

9.7 If the User declines to purchase LRO, the User shall be fully responsible for all repair costs,
damages, towing, and administrative fees arising from any accident, theft, or loss during the Lease
Term.

9.4 Upon valid claim and verification, the User’s financial responsibility will be limited to the Excess
Fee as listed in the table below, depending on the vehicle segment:

9.8 LRO coverage cannot be purchased or added once the Lease Term has commenced. It must be
confirmed before the vehicle handover.

9.9 LRO fees are non-refundable once subscribed, regardless of whether the User utilizes the
coverage during the rental period.

9.10 In cases where the User receives a vehicle upgrade, the applicable LRO rate and Excess Fee
shall be adjusted to match the new vehicle group or category.

9.11 International travelers who hold travel insurance from their home country are still required to
comply with Bigroad’s LRO policy. Bigroad operates on a “reimburse-first, claim-later” basis —
meaning all charges related to accident or theft must first be settled with Bigroad before any
external insurance claim can be made.

9.12 Bigroad reserves the right to revise the LRO fees, Excess Fees, and coverage conditions at any
time in accordance with company policy, insurance terms, or regulatory changes.

10. HOTEL AND TRAVEL PACKAGE SERVICES

10.1 In addition to car rental and limousine services, Bigroad also provides hotel accommodation
and travel package arrangements across Malaysia through its authorized partners, tour operators,
and hospitality affiliates.

10.2 Bigroad’s travel packages are designed to offer customers a seamless travel experience by
combining transportation, accommodation, and local experiences within a single booking. Each
package is carefully curated to ensure comfort, convenience, and value for money.

10.3 Hotel and travel packages offered by Bigroad may include the following services:

  1. (a) Hotel stays at participating partner hotels in major cities and destinations;
  2. (b) Transportation arrangements including car rental, airport transfers, and intercity travel;
  3. (c) Sightseeing tours, cultural experiences, and activity-based excursions;
  4. (d) Optional add-ons such as travel insurance, chauffeur service, and customized itineraries.

10.4 Bigroad currently offers travel and hotel packages covering major destinations such as:
Johor Bahru, Melaka, Kuala Lumpur, Ipoh, and Penang.
These destinations may expand from time to time, based on partnerships and seasonal offerings.

10.5 All hotel and package bookings are subject to availability, seasonal rates, and partner terms
and conditions. Certain packages may require advance booking or minimum stay durations,
particularly during festive seasons or public holidays.

10.6 Prices for travel packages are quoted in Ringgit Malaysia (RM) and are inclusive of applicable
government taxes unless otherwise stated. Any change in government-imposed charges, such as
SST or tourism tax, will be reflected accordingly in the final price.

10.7 Once confirmed, hotel and package bookings are non-transferable and subject to Bigroad’s
cancellation and refund policy as per Clause 6.

10.8 Bigroad acts as a coordinating service provider between the User and its network of hotels, tour
partners, and service suppliers. While every effort is made to ensure accuracy and reliability, Bigroad
shall not be held liable for any modification, delay, or cancellation by third-party providers due to
unforeseen circumstances.

10.9 Any request for amendment to hotel or tour bookings must be made in writing and is subject to
approval by Bigroad and its respective partners. Additional fees may apply depending on the nature
of the amendment.

10.10 Bigroad reserves the right to revise, substitute, or discontinue any travel package, hotel
partner, or related service at its discretion, with reasonable notice provided to the User where
applicable.

11. TERMINATION OF AGREEMENT

11.1 This Agreement may be terminated by either party under the conditions set forth in this section.
Upon termination, all rights granted to the User under this Agreement shall cease immediately, and
the leased vehicle or any ongoing service must be returned or discontinued as instructed by Bigroad.

11.2 Bigroad reserves the right to terminate this Agreement immediately without prior notice if the
User:

  1. (a) fails to make payment of rental charges, deposits, or any outstanding balance within the stipulated time;
  2. (b) breaches any term, condition, or obligation under this Agreement;
  3. (c) provides false, misleading, or incomplete information during the booking process;
  4. (d) uses the leased vehicle for any unlawful, negligent, or unauthorized purpose;
  5. (e) operates the vehicle in a manner likely to cause damage, danger, or loss to property or life;
  6. (f) allows the vehicle to be driven by a person not registered or approved by Bigroad;
  7. (g) is found to have tampered with the vehicle’s identification, tracking, or safety systems; or
  8. (h) acts in any way that may tarnish the reputation, operations, or goodwill of Bigroad.

11.3 In the event of termination under Clause 10.2, Bigroad shall have the absolute right to:

  1. (a) repossess the leased vehicle at the User’s cost, with or without prior notice;
  2. (b) recover all outstanding charges, penalties, and costs associated with the repossession or damage to the vehicle; and
  3. (c) forfeit any deposit or prepayment made by the User as compensation for losses incurred.

11.4 If termination occurs due to reasons beyond the User’s control — such as illness, accident, or
verified emergency — Bigroad may, at its sole discretion, review the situation and decide on a partial
refund or waiver of penalty on compassionate grounds.

11.5 Termination of this Agreement shall not affect any rights or remedies accrued to Bigroad prior to
the date of termination. All obligations that by their nature are intended to survive termination
(including payment of outstanding charges, fines, and damages) shall remain enforceable.

11.6 Bigroad reserves the right to pursue legal action against the User for recovery of damages,
losses, or costs incurred due to misuse, breach of contract, or unlawful conduct.

11.7 Upon termination, the User shall immediately return the leased vehicle and all related items
(including keys, documents, accessories, and equipment) to Bigroad or its authorized representative
at the location specified by Bigroad.

11.8 Any failure or delay by Bigroad in exercising its rights under this clause shall not be construed as
a waiver of those rights, and Bigroad may enforce them at any time it deems necessary.

12. GOVERNING LAW

12.1 This Agreement shall be governed by and construed in accordance with the laws of Malaysia,
and all disputes, claims, or proceedings arising out of or relating to this Agreement shall fall under
the exclusive jurisdiction of the courts of Malaysia.

12.2 In the event of any dispute or disagreement between the User and Bigroad, both parties shall
first attempt to resolve the matter amicably through discussion or mediation before initiating any
legal proceedings.

12.3 If any provision of this Agreement is found to be invalid, illegal, or unenforceable under
applicable law, such invalidity shall not affect the validity or enforceability of the remaining
provisions, which shall continue in full force and effect.

12.4 The headings and section titles used in this Agreement are for convenience only and shall not
affect the interpretation of any provision contained herein.

12.5 This Agreement represents the entire understanding between the User and Bigroad and
supersedes any prior agreements, representations, or communications, whether oral or written,
concerning the subject matter herein.

12.6 Any waiver, modification, or amendment to this Agreement must be made in writing and duly
authorized by Bigroad to be considered valid and binding.

ACKNOWLEDGMENT AND ACCEPTANCE

By proceeding with the booking and payment, the User hereby acknowledges that they have read,
understood, and agreed to all terms and conditions set forth in this Bigroad Car Rental & Travel
Service Agreement.

By clicking “I Agree” or completing a booking through Bigroad’s website, WhatsApp, or any official
platform, the User:

  1. (a) confirms acceptance of these terms as a legally binding agreement;
  2. (b) agrees to comply with all policies, including payment, cancellation, and vehicle use conditions; and
  3. (c) authorizes Bigroad to process and manage the booking in accordance with the information provided.

Bigroad reserves the right to amend or update these Terms and Conditions at any time.

The updated version will be published on Bigroad’s official website and shall take effect immediately
upon posting.-
